Don't let your employer pay you incorrectly: Speak out

Recognizing when you're being shorted on your paychecks might not be simple, but it's something you should make sure you're checking every time you receive one. Whether it's a missing hour of pay or overtime that hasn't been paid, you shouldn't allow someone to take advantage of your time.

For the most part, problems with pay are a result of honest mistakes. For that reason, it's important to talk to your employer if you notice a discrepancy. Keep your own time sheet and record the number of hours your work, so you can refer back to it if you feel there's a mistake.

Honest mistakes do happen, and when they do, employers usually fix those mistakes right away. If employers don't fix mistakes, then employees technically have a right to sue, so most employers will take steps to make corrections before allowing that to happen.

Will the Department of Labor hold an employer liable if they fail to pay correctly?

For the most part, yes. However, if it's clear that the employer made a mistake and did not intentionally misunderstand wage or hour laws, then the DOL may allow them to correct the mistakes without additional penalties. However, in cases where it's obvious that the employer was attempting to skip out on obligations, the DOL has the right to fine the employer for their actions.

Deliberately violating wage and hour laws is illegal, but it's more common than you may think. Be cautious with your paycheck, and make sure you speak up if you believe that there is a wage error.
