California requires training to prevent sexual harassment

Did you know that California law requires that larger employers have sexual harassment training sessions regularly? Two hours of sexual harassment training are required every two years to any supervisory employees according to the rules of the Fair Employment and Housing Act.

Sexual harassment is particularly disturbing to women in the workplace, though it can, and does, also affect men. Sexual harassment includes sexual advances that are unwarranted or unwanted as well as physical, verbal or physical conduct that is of a sexual nature. That can include actions such as:

  • Leering
  • Displaying sexually suggestive pictures
  • Touching or assaulting
  • Making threatening comments in response to rejected sexual advances

These are just a few examples of the types of harassment that people may deal with in the workplace.

Who has to train supervisors on sexual harassment in California?

Any employer who has five or more people working for them must train their supervisors and nonsupervisory employees. The sexual harassment prevention training must be provided by a qualified trainer, which might include people such as attorneys, human resources professionals, university instructors of some types or others. It's essential that the employer chooses qualified trainers.

What should you do if you're harassed on the job?

If you have been sexually harassed, it's in your best interests to try to obtain evidence or to get a witness on your side. Having at least something to prove that harassment is taking place will significantly help your case. Whether you have emails, a video or other documentation, make sure you have copies made and bring them with you to your attorney's office.
