What are the types of sexual harassment to report?

Sexual harassment happens to men and women at work. No one is truly safe from the possibility of being sexually harassed, and it can make the workday long and miserable.

The U.S. Equal Employment Opportunity Commission (EEOC) states that workplace sexual harassment includes sexual advances that are unwelcome as well as conduct of a sexual nature. The conduct may be intimidating or create a negative environment that is difficult to work in.

Sexual harassment is actually a form of discrimination, as listed in Title VII in the Civil Rights Act of 1964. Federally, this is the act that helps you file a claim against employers if you're harassed. Your state may have additional laws that could be stricter than the Civil Rights Act, which is something your attorney will look into on your behalf.

What kinds of sexual harassment are there?

There are two kinds, hostile work environment and quid pro quo. With the hostile work environment, the harassment claim will be validated based on the frequency of the conduct, the type of conduct that took place (physical or verbal) and if the conduct was offensive or hostile. The court also looks at who was harassed and if it was an individual or group. The victim has to show that they believed that the conduct was abusive, offensive or hostile. They also have to show that other reasonable people would consider the acts abusive, offensive or hostile as well.

Quid pro quo harassment is different because the supervisor or employer asks others to tolerate harassment to keep their jobs, benefits, right to a promotion or raises.

If you are a victim of harassment, speak up for yourself. This is unacceptable behavior in the workplace, and you have a right to work in a safe environment.
